  1. Preliminary
    • The website at breezebalm.com is operated by Leonard Enterprises Pty. Ltd. ACN 614 989 678 trading as Breeze Balm (we, us, our).
    • This privacy policy sets out how we deal with personal information and sensitive information.
  2. Definitions

In this privacy policy:

  • Australian Privacy Principles mean the Australian Privacy Principles contained in the Privacy Act 1988 (Cth), schedule 1.
  • Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable:
    • whether the information or opinion is true or not; and
    • whether the information or opinion is recorded in a material form or not.
  • Sensitive information means:
    • information or an opinion about an individual's:
      • racial or ethnic origin;

      • religious beliefs or affiliations;
      • philosophical beliefs;
      • membership of a professional or trade association;
      • membership of a trade union;
      • sexual orientation or practices; or
      • criminal record,

that is also Personal Information; or

  • health information about an individual; or
  • genetic information about an individual that is not otherwise health information; or
  • biometric information that is to be used for the purpose of automated biometric verification or biometric identification; or
  • biometric templates.
  • Services means any services we have agreed to provide to You.
  • You means the individual about whom we are collecting Personal Information or Sensitive Information.
  1. Collection of your personal information
    • Anonymity and pseudonymity

Due to the nature of the Services we provide, it is impractical for us to deal with You without knowing your full name. When You register for our Services, You are required to use truthful and accurate information and You will not have the option to use a pseudonym.

We will only disclose your Sensitive Information for the purposes for which You gave it to us, or for directly related purposes You would reasonably expect, or if You agree.

    • If we receive Personal Information that we did not solicit, we will, within a reasonable period after receiving the information, determine whether we could have lawfully collected the information had we solicited it.
    • If we determined that we could have lawfully collected the information had we solicited it, we will deal with that information in accordance with this privacy policy. If, however, we determine that we could not have lawfully collected the information had we solicited it, then we will destroy or de-identify that Information as soon as practicable, where it is lawful and reasonable to do so.

We will only use or disclose your Personal Information for the purpose of direct marketing by us or third parties where you ‘opt in’.

  1. Cookies and web beacons
    • We may use cookies on our Site from time to time. Cookies are text files placed in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our Site with personal information, this information may be linked to the data stored in the cookie.
    • We may use web beacons on our Site from time to time. Web beacons (also known as clear GIFs) are small pieces of code placed on a web page to monitor the visitor’s behaviour and collect data about the visitor’s viewing of a web page.     • Sometimes we contract with third parties to perform Services on our behalf. When we do that, we will only provide those third parties with such information about You as they need to perform those Services.
    • Sometimes the third party is located overseas. The territories in which our third party service providers are located are:

    • We will take reasonable steps to protect Personal Information that we hold from:
      • misuse, interference and loss; and
      • unauthorised access, modification or disclosure.
    • We will destroy or de-identify Personal Information when we no longer need it and we are not required by law or a court / tribunal order to retain it.
  4. Business transfer
    • If we were to sell our business or substantially all of our assets, your Personal Information would be one of the assets that is transferred to the buyer.
    • You consent to:
      • us transferring your Personal Information to a third party that buys our business or substantially all of our assets; and
      • the third party buyer continuing to use your Personal Information as set out in this policy.

If You ask, in most cases we will give You access to the Personal Information or Sensitive Information that we hold about You, and take reasonable steps to correct it if we consider it is incorrect.
